Family mediation (Domestic Mediation) is a key pillar of the ADR (Alternative Dispute Resolution) family.
The system is focused on providing a dispute resolution mechanism to family members who are in some sort of dispute. In fact, divorce mediation forms a very important part of our family mediation services. Incidentally, we at Seek Mediation also provide a unique Divorce-prevention mediation program.
Family mediation is based on the same fundamental principles that apply in mediation otherwise. While it is voluntary and transparent, it also involves mutual respect and good faith. It is non-confrontational in nature and progressive. It encourages parties to focus on the future rather than the problems of the past.
You are most welcome to get your lawyer along for the mediation session if you feel like doing so. All legal advice should be sought from your own lawyer**. In fact, we encourage that you should get the final draft settlement vetted from your legal counsel before signature.
**Please note that we at Seek Mediation do not provide any legal advice.
The Law Says:
“In India, Section 9 of the Family Court Act 1984, makes is it mandatory to settle a matrimonial dispute in relation to maintenance, child custody, divorces, etc., through the process of mediation. Therefore, an attempt to resolve differences through mediation is a must for all the divorcing couples to give their marriage one more chance.”
